The first sentence matters as much as the second. This is not a demand from one community that the rest of the country is being asked to accommodate. It is one of the few propositions in American politics that finds agreement across almost every constituency, which makes it one of the few places where a disciplined bloc can actually win something.
Ask Americans of nearly any background whether an innocent person should be able to afford a defense, whether a man should sit in jail before trial because he cannot post money, whether a teenager should be charged as an adult, or whether a sentence should destroy a person's ability to work for the rest of his life. The answers are not close, and they are not partisan.
The gap is not public opinion. The gap is that no organized constituency has made these questions the price of its vote. That is precisely the function this party exists to perform, and it is why justice reform sits high on the list of things a Black American bloc should be bargaining for rather than hoping for.
The word is doing specific work. Individual prosecution is what a justice system is for. Wholesale prosecution is what happens when the system stops handling people one at a time: when the charging decision follows the neighborhood, when the school hands a child to a police officer over conduct that used to reach the principal, when the plea offer is calibrated to the defendant's inability to risk a trial, and when the outcome is predictable from the zip code before any facts are known.
Once the system operates at volume, guilt and innocence stop being the variables that decide who is inside. Money and representation decide it. Our young people supply the volume.
This party will not trade the right to be safe against the right to a fair process. Black Americans are simultaneously the population most likely to be over-prosecuted and the population most likely to be under-protected - the same neighborhoods where a young man is charged aggressively are the neighborhoods where a murder is least likely to be solved.
Both facts describe the same failure: a system that is not accountable to the people it operates on. Reform, in this party's use of the word, means restoring that accountability, not choosing which half of the community to abandon.
The policing chapter states what the party wants from the officer, the prison reform chapter states what it wants from the sentence, and the crime chapter states what it wants from the community itself. This chapter states the argument the party takes into a coalition - because on this issue, unusually, there is a coalition to be had.
